I. In accordance with the letter of the Taipei City Government Department of Health, No. Bei Shi Wei Jian Zi Di 1133021998, dated August 27, 113.
II. The amended Tobacco Hazards Prevention Act, which came into effect on March 22, 112, reiterates and explains the important provisions as follows:
(I) Complete prohibition of electronic cigarettes:
1. Users: Fined NT$2,000 to NT$10,000.
2. Suppliers: Fined NT$10,000 to NT$250,000.
3. Sellers and exhibitors: Fined NT$200,000 to NT$1,000,000, and shall be ordered to improve, recall, destroy, or return the goods within a specified period. Failure to do so within the specified period will result in penalties for each offense.
(II) Designated tobacco products (such as heated tobacco products) or their necessary components that have not been reviewed and approved by the central competent authority:
1. Users: Fined NT$2,000 to NT$10,000.
2. Suppliers: Fined NT$10,000 to NT$250,000.
3. Sellers and exhibitors: Fined NT$200,000 to NT$1,000,000, and shall be ordered to improve, recall, destroy, or return the goods within a specified period. Failure to do so within the specified period will result in penalties for each offense.
(III) Prohibition of smoking for persons under 20 years of age:
1. Smokers shall be ordered to receive smoking cessation education within a specified period; for minors, their parents or guardians shall be ordered to ensure their attendance.
2. Persons under 20 years of age who fail to receive smoking cessation education without a valid reason shall be fined NT$2,000 to NT$10,000 for each offense; if the offender is a minor, their parents or guardians shall be penalized.
(IV) Expansion of smoke-free public places:
1. All levels of schools, kindergartens, infant care centers, and home-based childcare service places are newly added as smoke-free areas.
2. Indoor areas of bars and nightclubs are newly added as smoke-free areas. However, this does not apply to indoor smoking rooms or cigar lounges with independent air conditioning and separate compartments within such places.
3. Violators who smoke in prohibited areas shall be fined NT$2,000 to NT$10,000.
